In Utah, process may be served by any person who is 18 years or older and is not a party to the action. Utah Process Service employs trained, experienced servers who understand proper service procedures under the Utah Rules of Civil Procedure.
Utah Rule of Civil Procedure 4 allows personal service (in-hand delivery), service at the individual's usual place of abode with a person of suitable age and discretion, and service upon an authorized agent. In some cases, the court may authorize alternative service methods such as service by publication or service by mail.
Most routine service along the Wasatch Front is completed within 3 to 5 business days. Service in rural counties may take slightly longer. Rush and same-day service are available for an additional fee. The exact timeline depends on the location, the availability of the person being served, and the type of service required.
We make multiple attempts at different times and days to effect service. If the individual continues to avoid service, we can provide detailed due diligence documentation to support a motion for alternative service with the court. We also offer skip tracing to locate individuals who have moved.
We provide a sworn affidavit of service (also called a return of service) that documents the date, time, location, and manner of service. This affidavit is suitable for filing with Utah courts and meets all requirements for proof of service under the Utah Rules of Civil Procedure.
